Exemptions in planning legislation are provisions made in the law to reduce red tape and allow property owners to carry out certain types of development without unnecessary regulation, policing and oversight.
In the ACT (Australian Capital Territory) there are two different exemption provisions; development exemptions and building exemptions.
- Development exemptions allow you to carry out certain specified developments so as long as you obtain building approval/sign off by a certifying authority.
- Building exemptions provisions are tighter than development exemption provisions however developments that satisfy the building exemptions criteria can be carried out without even obtaining building approval/sign off by a certifying authority.
